1. Acceptance and eligibility

You must be at least 18 years old, or acting with the permission and supervision of a parent or legal guardian, to create an account or place an order. If you place an order for another person or business, you confirm that you are authorized to provide the necessary information and accept these Terms on their behalf.

If you do not agree to these Terms, do not submit an order through the website.

2. Website use and customer accounts

Use the website only for lawful shopping and related purposes. You are responsible for providing accurate, current information and for maintaining the confidentiality of your account credentials. Notify us promptly if you believe your account has been accessed without authorization.

You may not interfere with the website, attempt unauthorized access, introduce malicious code, use automated tools in an abusive manner, copy the store catalog for unauthorized commercial use, submit fraudulent orders, or use the website in a way that harms customers, staff, or third parties.

We may restrict or suspend access when reasonably necessary to protect the website, investigate misuse, comply with law, or prevent fraud or security incidents.

3. Products, packaging, and food information

We make reasonable efforts to present products accurately. Manufacturers may change packaging, labels, ingredients, size, color, country of origin, or other details without prior notice. Images are illustrative and may not show the exact packaging delivered.

Always review the label and instructions on the physical product before use or consumption. Website descriptions are not a substitute for manufacturer labels, allergy warnings, dietary guidance, or medical advice. If you have an allergy, sensitivity, dietary restriction, or question about a product, contact us before ordering and verify the physical label before consumption.

Unless a product page clearly states that an item is sold by variable weight, the displayed price applies to the package, unit, or quantity identified on that page. Variable-weight purchasing will be governed by the information displayed on the product page and checkout if that feature is introduced.

4. Pricing, promotions, and availability

Prices and promotions shown online may differ from in-store offers unless expressly stated otherwise. Prices, coupons, promotions, product limits, and availability may change before an order is submitted. Applicable taxes and fulfillment charges are shown during checkout.

Inventory information may not always reflect a simultaneous in-store sale, damage, supplier change, or other availability issue. If an item becomes unavailable, Albalad by Thimar will follow the substitution preference recorded with the order. If the selected preference cannot be followed, the store may contact the customer before changing the order. An unavailable item that is not provided is removed from the order and its applicable amount is adjusted or refunded. We will not charge for an unavailable item that we do not provide.

If a product, price, promotion, tax, or fee is displayed incorrectly, we may correct the error before accepting or fulfilling the affected order. If payment has already been collected for a cancelled item or order, the applicable amount will be refunded.

5. Orders and order acceptance

Submitting an order is an offer to purchase the listed items under these Terms and the information shown at checkout. An automated order receipt confirms that we received the request; it does not guarantee availability or prevent review for pricing, payment, security, address, eligibility, or fulfillment issues.

We may accept an order by confirming that it is being prepared, beginning fulfillment, or otherwise communicating acceptance. We may limit quantities or decline or cancel an order for legitimate reasons, including product unavailability, incorrect information, suspected fraud, payment failure, safety concerns, fulfillment limitations, or legal requirements. When practical, we will notify you using the contact information provided with the order.

You are responsible for reviewing the cart, contact information, addresses, fulfillment selection, fees, and order total before submitting the order.

6. Payments, charges, and taxes

Available payment methods are the methods displayed at checkout. A payment option is not available unless it appears for the selected order and fulfillment method. If Pay at Pickup is offered, payment is due when the order is collected under the instructions shown at checkout and in the order confirmation.

When electronic payment is available, you authorize the payment provider displayed at checkout to process the order total and any properly disclosed adjustment. Payment providers may apply their own terms, verification requirements, and privacy practices.

The final checkout total may include merchandise, discounts, shipping or delivery charges, and applicable taxes. You are responsible for charges that you authorize. Contact us promptly if you believe an order or charge is incorrect.

7. Free Store Pickup, Virginia Local Delivery, and U.S. States Delivery

Free Store Pickup: Wait until you receive a Ready for Pickup notice before traveling to the store. Bring the order confirmation and any identification reasonably requested to protect the order. Pickup is available at the location and under the instructions shown during checkout.

Virginia Local Delivery: This method is limited to eligible Virginia addresses and is subject to the merchandise minimum, delivery fee, and conditions displayed at checkout and in the Virginia Delivery Policy. Delivery timing is arranged with the store after an eligible order is accepted.

U.S. States Delivery: This method is limited to eligible shelf-stable products and eligible U.S. addresses outside Virginia. Rates are based on the store’s shipping rules rather than live carrier quotes. Details appear in the Shipping & Delivery Policy and at checkout.

International destinations and U.S. territories are not currently supported. Fulfillment dates are estimates unless expressly guaranteed. If a shipped order cannot be sent within the promised or legally required period, we will provide notice and any cancellation or refund options required by applicable law.

8. Changes, cancellations, returns, and refunds

Contact customer service promptly if you need to request an order change or cancellation. A request is not guaranteed and may be unavailable after preparation, pickup, delivery, or shipment has begun.

Inspect the order promptly after pickup or delivery. Report incorrect, missing, damaged, spoiled, or quality-affected items as soon as reasonably possible and retain the product, packaging, receipt, and photographs when relevant. Requests are reviewed under the Returns & Refunds Policy and applicable law.

Perishable, opened, used, temperature-sensitive, or food-safety-sensitive products may not be eligible for ordinary returns, except where required by law or where the item is defective, damaged, incorrect, spoiled, or otherwise qualifies under our policy. Approved refunds are issued to the original payment method when possible, unless another method is agreed upon or required by law.

9. Privacy, intellectual property, and third-party services

Our collection and use of personal information are described in the Privacy Policy.

The Albalad by Thimar name, logo, original website design, photographs, graphics, and written content are protected by applicable intellectual-property rights. You may use the website for ordinary shopping and personal reference, but may not reproduce or commercially exploit protected content without permission.

The website may rely on third-party hosting, payment, tax, email, security, shipping, mapping, or other services. Those providers may have their own terms and privacy policies. We are not responsible for an independent third party’s website or service, but nothing in these Terms limits responsibility that cannot lawfully be excluded.

The website is provided on an “as available” basis. Temporary interruptions, maintenance, technical errors, or third-party outages may occur. To the fullest extent permitted by law, Albalad by Thimar is not responsible for indirect or consequential losses arising solely from use of, or inability to use, the website. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be waived.

10. Changes to these Terms, applicable law, and contact information

We may update these Terms for future website use and future orders. The Last Updated date displayed on this page identifies the current version. Material changes apply prospectively unless applicable law permits or requires otherwise.

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without limiting any mandatory consumer protection that applies to you. Any dispute that cannot be resolved directly will be handled by a court of competent jurisdiction, subject to applicable law.
